Steps for In-State Transfer of an NFA Item:
1. Buyer Responsibilities:
• Fill out ATF Form 4. The buyer initiates the paperwork to apply for the transfer of the NFA item into their name.
• Fingerprint cards and passport photos. These are required if the buyer is an individual (as opposed to a trust or corporation).
• Notify local CLEO (Chief Law Enforcement Officer). The buyer must submit notification forms to their CLEO (e.g., local police chief or sheriff).
• Pay the $200 transfer tax. This is required for the transfer of most NFA items (except certain AOWs).
2. Seller Responsibilities:
• Provide the serial number and item information for the Form 4.
• Hold the item until ATF approval is complete. The seller cannot transfer possession of the item to the buyer until the approved Form 4 is returned.
• Coordinate with the buyer to ensure all required documentation is completed and submitted properly.
3. Form Submission and Transfer:
• The buyer submits the completed Form 4 along with the transfer tax payment to the ATF.
• Once approved (which can take several months), the ATF returns the approved Form 4, and the seller can transfer possession of the NFA item to the buyer.
